Notice is hereby given in compliance with Georgia Code 22-2-109 and 32-3-5 that the Georgia Department of Transportation has approved the Location and Design of this project.

The date of location and design approval is: April 30, 2026

The proposed project is located at the intersection of SR60/US19 and Austin Way in the city of Dahlonega, in Land Lot 993. The project is approximately 0.2 miles in length.

The project will construct a two-tiered, tie-back wall along the eastern side of SR60/US19 just south of Austin Way; construction also includes drainage, guardrail, and resurfacing. The estimated time for construction is 24 months, and no off-site detour will be required.

The Georgia Department of Transportation would be responsible for acquiring property rights for this project.

Drawings or maps or plats of the proposed project, as approved, are on file and are available for public inspection at the Georgia Department of Transportation:

NOTICE OF SALE UNDER POWER LUMPKIN COUNTY

WHEREAS, on April 30, 2009, a certain Security Deed was executed by Ann Stancil as grantor in favor of Generation Mortgage Company as grantee and was recorded on May 13, 2009, in Deed Book 1130, Page 656 in the Office of the Clerk of Superior Court, Lumpkin County, Georgia; and

WHEREAS, the Security Deed was insured by the United States Secretary of Housing and Urban Development (the Secretary) pursuant to the National Housing Act for the purpose of providing single family housing; and;

WHEREAS, the Security Deed is now owned by the Secretary, pursuant to an assignment recorded on January 23, 2019 and recorded in Deed Book 1412, Page 211, in the Office of the Clerk of Superior Court, Lumpkin County, Georgia; and

WHEREAS, a default has been made in the covenants and conditions of the Security Deed in that the payment due upon the death of the borrower was not made and remains wholly unpaid as of the date of this notice, and no payment has been made sufficient to restore the loan to currency; and

WHEREAS, the entire amount delinquent as of May 5, 2026 is $819,977.00 plus applicable fees and costs; and

WHEREAS, by virtue of this default, the Secretary has declared the entire amount of the indebtedness secured by the Security Deed to be immediately due and payable;

The sale will be held at the Lumpkin County Courthouse or at the usual place of conducting Sheriffs sales. Per the Secretary of Housing and Urban Development, the estimated opening bid will be $824,565.92 plus applicable fees and costs, and any other amounts that become due as of the date of sale; and

There will be no proration of taxes, rents or other income or liabilities, except that the purchaser will pay, at or before closing, his prorate share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale.

When making their bids, the winning bidders with the exception of the Secretary must submit the total purchase price in the form of a certified check or cashier's check made payable or endorsed to the undersigned Foreclosure Commissioner. If the Secretary is the highest bidder, he need not pay the bid amount in cash. The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the date of sale and all other costs associated with the transfer of title.

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser (s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. The amount that must be paid if the Security Deed is to be reinstated prior to the scheduled sale is based on the nature of the default. A total payoff is required to cancel the foreclosure sale or the breach must be otherwise cured.
