TAKE NOTICE that on November 14, 2020, law enforcement officers of the Lumpkin County Sheriff's Office, in conjunction with officers with the Georgia State Patrol, seized $3306 in United States Currency (hereinafter “the seized property”) and several bags of marijuana from the above individual's vehicle at 211 Glen Cedar Lane, Dawsonville, Lumpkin County, Georgia. The vehicle was searched after James, the driver, fled form state troopers attempting to perform a traffic stop.

The seized property was directly or indirectly used or intended for use to facilitate the possession with the intent to distribute of marijuana in violation of O.C.G.A. § 16-30-30, and is proceeds derived or realized therefrom and was found in close proximity to marijuana and other property which is subject to forfeiture pursuant to the provisions of O.C.G.A. § 16-13-49(b).

AND FURTHER TAKE NOTICE that the owner or interest holder may file a claim to the seized property within thirty (30) days after service by sending the claim to the District Attorney for the Enotah Judicial Circuit, 325 Riley Road, Dahlonega, Georgia, by certified mail or statutory overnight delivery, return receipt requested. The claim must be signed by the owner or interest holder and provide the following: 1) The name of the claimant; 2) The address at which the claimant resides; 3) A description of the claimant's interest in the property; 4) A description of the circumstances of the claimant's obtaining an interest in the property and, to the best of the claimant's knowledge, the date the claimant obtained the interest and the name of the person or entity that transferred the interest to the claimant; 5) The nature of the relationship between the claimant and the person who possessed the property at the time of the seizure; 6) A copy of any documentation in the claimant's possession supporting hes or her claim; and 7) Any additional facts supporting his or her claim.

Clerk of the Superior Court

The Grand Jury received a report from Rita Harkins, Clerk of Court, concerning receipts and disbursements of the fiscal operations of the Superior Court Clerk's Office. The return presented by Rita Harkins is that required by O.C.G.A. 36-1-7(a) did appear to be in order. A copy of said report is attached as part of these minutes. We thank the Clerk, Rita Harkins, for their assistance.

When the Grand Jury reconvenes, it will consider Board of Equalization Appointments.

Lumpkin County
Commissioner's Office

This Grand Jury received a report from Stan Kelley, County Manager, Allison Martin, Special Projects Director, and Abby Branson, County Finance Director, concerning the receipts and disbursements of the fiscal operations of the Office of County Commission and the most recent county audit. A copy of said report is attached as part of these minutes. We thank the County Commissioner's Office personnel for their assistance.

Lumpkin County Sheriff's Office

This Grand Jury received a report from Stacy Jarrard, Sheriff, concerning fiscal operations o the Sheriff's Office. The report presented by Sheriff Jarrard is that required by 36-1-7(a) did appear to be in order. All funds involving the Sheriff's Office are handled through the County Commissioner's Office and are accounted for in the Commissioner's report. We wish to thank the Sheriff and his staff for their help and cooperation.

Lumpkin County Detention Center

The Sheriff's department Jail Book was reviewed and found to be in order, in accord with O.C.G.A. 42-4-7.

An inspection of the Lumpkin County Detention Center was conducted and it was found to be extremely clean and in good order. The Sheriff's department is commended for its excellent condition and professional management.

COMMENDATIONS

This Grand Jury extends its appreciation to the Honorable T. Buckley Levins for his assistance to this body.

This Grand Jury commends our bailiff, Ann Carder and Jerry Seabolt, for their commitment to this Grand Jury.

This Grand Jury would like to commend our District Attorney, Jeffrey Langley, as well as his assistants and staff, for their courtesy, patience and wise counsel. We would like to thank all of the law enforcement witnesses for their courteous and professional manner when reporting to this jury.

We, the Grand Jury, wish to comment Stan Kelley for his 29 years of faithful service to Lumpkin County, both as Chief Deputy Sheriff and as County Manager. Stan Kelley's loyalty, dedication and integrity has been remarkable and we thank him for his service to the citizens of Lumpkin County.

RECOMMENDATIONS

We, the Grand Jury, recommend County Detention Center personnel pay be increased from the current base rate of $12.63 per hour to be commensurate with the Enotah Circuit District, as well as Dawson and Hall Counties in order to retain quality personnel as well as decrease turnover.

The February 2021 Spring Term of the Lumpkin County Grand Jury was sworn, charged and convened on February 22, 2021.

This Court has been informed that the Grand Jury has further criminal matters to address.

IT IS HEREBY ORDERED that the Lumpkin County Grand Jury be reconvened into session under the original oath and charge of the court, beginning April 20, 2021 at 9:00 a.m. and April 21, 2021 at 9:00 a.m, and continue in session until its work is completed or adjourned.

It is further ORDERED that the attending members of the Grand Jury be compensated for their service for each attended session.
