gpn11 NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT STATE OF GEORGIA LUMPKIN COUNTY Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Joseph S Morgan and Kimberly H. Morgan aka Kimberley H. Morgan to ABN AMRO Mortgage Group, Inc. in the original principal amount of $73,500.00 dated 09/08/2005, and recorded in Deed Book M36, page 731, Lumpkin County records, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door in said County, during the legal hours of sale, on the first Tuesday of August, 2014 by CitiMortgage, Inc., successor by merger with ABN AMRO Mortgage Group, Inc., as Attorney-in-Fact for Joseph S Morgan and Kimberly H. Morgan aka Kimberley H. Morgan the following described property: All that tract or parcel of land lying and being in Land Lot 448, 15th District, 1st Section, Lumpkin County, Georgia being 1.095 acres, more or less, and being more particularly described on that certain plat of survey prepared for John R. Crawford, III, & Sheila K. Ricketts Crawford by GeoImage, LLC on June 7, 2005, filed in Cabinet One, Slide 119, Plat 171A, Lumpkin County, Georgia records. This property is conveyed together with an easement for access, ineress, egress and the installation of utilities connecting the subject property with a county maintained public road as shown on the above referenced plat of survey, Property known as: 193 Hide Away Road, Dahlonega, GA 30533 The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney's fees, (notice having been given as provided by law). The property will be sold as the property of Joseph S Morgan and Kimberly H. Morgan aka Kimberley H. Morgan subject to the following: (1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the security deed first set out above.
